Context Matters: U.S. Supreme Court Decision and DEI Programs

The legal opinion issued by Colorado Attorney General Weiser addresses questions and concerns arising from the U.S. Supreme Court decision in Students for Fair Admissions, Inc. v. Harvard College and Students for Fair Admissions, Inc. v. University of North Carolina. In these cases, the court ruled that race-conscious admissions programs at colleges and universities violated the Equal Protection Clause of the U.S. Constitution and Title VI of the Civil Rights Act concerning college admissions.

However, it's important to note that the Supreme Court's ruling specifically pertained to college admissions processes and did not extend to DEI programs in workplaces. DEI initiatives in workplaces are governed by Title VII of the Civil Rights Act of 1964, which remains unaffected by the Supreme Court decision. On Monday, April 17, 2023, Colorado Behavioral Health Administration (BHA) Commissioner, Morgan Medlock, MD, MDiv, MPH, a Black community leader, was unjustly removed from her Colorado cabinet position without cause. Her removal risks the lives of millions of people in Colorado who deserve accessible, trauma-informed, and culturally responsive behavioral health care. It also perpetuates the message that strong, qualified Women of Color are vulnerable to the whims of political systems and cabinet leadership.
